Is it possible that Criterion could buy Kubrick's early films?

With MGM selling it’s back catalog is there a possibility that Criterion could get purchase the rights to release Stanley Kubrick’s first three studio pictures The Killing, Killer’s Kiss, and Paths of Glory? It seems appropriate that Criterion should have something else by Kubrick besides Spartacus.
